Composition with creditors after bankruptcy:
legal cause for the termination of bankruptcy, a constitutive negotiation act by which an agreement between the bankrupt person(s) or a third party (creditor or not) and the creditors themselves is replaced by the bankruptcy liquidation, in compliance with the principle of par condicio creditorum.
Agreement among creditors:
instrument to resolve the corporate crisis that is implemented through a negotiation agreement between the debtor company and the creditors, whose intention is expressed by credit majorities, aimed at corporate recovery and debt restructuring.
Business crisis:
situation or set of situations in which the economic and financial equilibrium conditions of the company are determined to be such as to compromise the prospect of business continuity.
Plan of reorganisation:
tool of the entrepreneur, included among "minor bankruptcy procedures", to restore the company and to bring it back into economic and financial balance through the implementation of a series of strategic operations, without any control by the court (as is the case in traditional bankruptcy procedures).
Piano attestato:
strumento dell’imprenditore, rientrante fra le “procedure concorsuali minori“, per risanare l’impresa e riportarla in equilibrio economico e finanziario, attraverso la realizzazione di una serie di operazioni strategiche, senza che vi sia alcun controllo da parte del tribunale (come invece avviene nelle procedure concorsuali tradizionali).
